Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Sacramento Garden Trellis website (the “Site”) and any purchase of products through the Site. The Site is operated by Midplane Designs LLC, doing business as Sacramento Garden Trellis (“we,” “us,” “our”).

By accessing the Site or placing an order, you agree to these Terms.

2) Eligibility and Use of the Site

You must be able to form a legally binding contract to use the Site and purchase products. You agree not to misuse the Site, attempt unauthorized access, or interfere with Site functionality.

3) Products

We sell 3D-printed garden trellis accessories (the “Products”). Products are produced on demand and fulfilled by our production and shipping partners, including Printie (manufacturing/fulfillment) and Shippo (shipping label and carrier services), along with carriers such as USPS/UPS/FedEx as available.

3D printing variations: Because Products are 3D-printed, minor cosmetic variations may occur (including layer lines, small surface differences, and slight color variation). These do not affect function and are not considered defects.

4) Intended Use and Safety Disclaimer

Products are intended for gardening and trellis use only.

Products are not load-bearing, not safety-critical, and not designed for human support, climbing, fall prevention, overhead loads, or any application where failure could cause injury or property damage. You are responsible for selecting appropriate materials and installation methods for your specific use.

To the fullest extent permitted by law, we disclaim responsibility for injuries, damages, or losses arising from improper use, installation, modification, or use outside intended purposes.

5) Guides and Educational Content Disclaimer

The Site may include guides, instructions, recommendations, and other informational content (“Guides”). Guides are provided for general informational purposes only and do not constitute professional advice.

You are responsible for evaluating the information and determining whether it is appropriate for your situation, including compliance with applicable codes, permits, HOA rules, property conditions, and safety requirements.

Building and installing trellises involves risks, including injury and property damage. You assume all risk for any project you undertake and for any use of information from the Site.

6) Professional Referral Disclaimer

The Site may include references to or recommendations for third-party professionals (such as installers, builders, landscapers, or contractors) (“Professionals”). Professionals are independent third parties and are not employees, partners, agents, or representatives of Midplane Designs LLC (dba Sacramento Garden Trellis).

We do not control, warrant, or guarantee any Professional’s work, pricing, availability, licensing, insurance, or compliance with laws. Any agreement you enter into with a Professional is solely between you and the Professional, and you are responsible for verifying qualifications, insurance, licensing, references, and suitability.

7) Ordering, Acceptance, and Pricing

When you place an order, you are making an offer to purchase. We may accept or decline orders in our discretion, including in cases of suspected fraud, production constraints, or obvious pricing errors.

If an order is canceled or declined after you place it, we will issue a refund for any amounts charged.

Prices are shown in the currency displayed at checkout. We may change prices at any time, but changes do not affect orders already accepted.

8) Taxes

We collect sales tax where required by law, based on the ship-to address and applicable rules at the time of purchase.

9) Payment

You authorize us (and our payment processors) to charge your selected payment method for the total shown at checkout, including product price, shipping, and taxes.

10) Production Time, Shipping, and Delivery

Handling/production time: Typical handling and production time is 3 to 5 business days before shipment.

Shipping: Shipping transit times shown at checkout are estimates only and are not guarantees.

Delivery confirmation: Delivery is determined by the carrier’s tracking status showing delivered to the shipping address provided at checkout.

Address accuracy: You are responsible for providing an accurate shipping address. If a package is returned or undeliverable due to an incorrect or incomplete address, we may (at our option) reship it at your cost or refund the order.

11) Refunds and Warranty

Refund and warranty terms are described in our separate Refunds and Warranty Policy, which is incorporated by reference into these Terms.

Refunds, replacements, and remedies related to an order are governed exclusively by the Refunds and Warranty Policy. If there is a conflict, the Refunds and Warranty Policy controls for refund and warranty issues.

12) Limitation of Liability

To the fullest extent permitted by law, Midplane Designs LLC (dba Sacramento Garden Trellis) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Products or the Site will not exceed the amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13) Intellectual Property

The Site, product designs, text, graphics, photos, logos, and other content are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute our content without written permission.

14) Reviews, Photos, and User Content License

If you submit content to us or on the Site (including reviews, photos, videos, or testimonials) (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, display, and distribute that User Content for marketing, promotional, and other business purposes, including on our Site and social media, with or without attribution.

You represent that you own or have the necessary rights to submit User Content and that it does not violate any law or third-party rights.

We may remove User Content at any time for any reason.

15) Privacy

Our collection and use of personal information is described in our separate Privacy Policy, which is incorporated by reference into these Terms.

16) Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

17) Disputes

We will try to resolve issues quickly and informally. If you have a concern, contact info@sacgardentrellis.com first.

If a dispute cannot be resolved informally, it will be brought in the state or federal courts located in California, and you consent to jurisdiction and venue there, unless applicable law requires otherwise.

18) Electronic Communications

By using the Site or placing an order, you consent to receive communications from us electronically, including via email at the address you provide, and you agree those communications satisfy legal notice requirements.

19) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, weather, supply chain issues, platform outages, labor actions, or acts of government.

20) Severability

If any provision of these Terms is held invalid, the remaining provisions will remain in effect.

21) No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

22) Assignment

You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.

23) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” above will reflect the latest version. By continuing to use the Site after changes take effect, you agree to the updated Terms.

24) Entire Agreement

These Terms (together with any policies referenced, including the Refunds and Warranty Policy and Privacy Policy) constitute the entire agreement between you and us regarding the Site and your purchase of Products.
